USCIS announced on September 30 that it is raising several of the fees created by the One Big Beautiful Bill Act (H.R. 1) for fiscal year 2027. The Department of Homeland Security notice (FR Doc. 2026-20187, CIS No. 2879-26) goes on public inspection today and publishes in the Federal Register on October 1. The new amounts apply to any filing postmarked on or after October 16, 2026, which is 15 days after publication. DHS says filings sent on or after that date without the correct fee “will be rejected.”
H.R. 1, signed July 4, 2025, set these fees as statutory minimums and requires an adjustment every year based on the Consumer Price Index for All Urban Consumers (CPI-U). DHS measured the change from July 2025 (323.048) to July 2026 (333.918), an increase of about 3.36%. The statute requires most fees to be rounded down to the next lowest $10, so several do not change at all.

In a companion notice (FR Doc. 2026-20186), ICE raised two enforcement fees from $5,130 to $5,300, effective the same day. One applies to people ordered removed in absentia who are later arrested. The other applies to inadmissible noncitizens apprehended between ports of entry.
What it means. These H.R. 1 charges are separate from, and added on top of, the regular USCIS fee schedule. Employment-based filings such as the I-140, NIW petitions, H-1B petitions and the standard I-485 are not on this list, so their fees do not change under this notice. The people affected are asylum seekers, parolees, TPS holders and SIJ petitioners, along with anyone preparing a first work permit in those categories. Anyone mailing a package close to the deadline should check the postmark date. Packages postmarked on or after October 16 need the new amounts, and USCIS says it will reject them rather than ask for the difference. This is the second annual adjustment. The first, published November 21, 2025, took effect January 1, 2026. This year’s comes with less than three weeks’ notice. DHS also says it may later codify the annual adjustments in 8 CFR part 106.
